Rape trial reset for Nov. 14; suspect out on bail

The Wenatchee High School freshman charged with three counts of second-degree rape appeared in court this morning — but not in custody, as he was at the last hearing. A Chelan County Clerk’s Office staffer said this afternoon that the 14-year-old was bailed out of juvenile detention Oct. 1.

The rape trial has been delayed to Nov. 14.

The court set the defendant’s bond at $50,000 on Sept. 11, and applied hefty release conditions should bond be posted. The stipulations include not engaging in assaultive or harassing behavior, avoiding all contact with the victims, not having contact with children under the age of 11 unless supervised by a responsible adult who is aware of the rape allegations, not accessing cable television, an internet capable computer, or email “unless directly supervised by a responsible approved adult,” according to the court’s order of detention and release. The defendant is also restricted of having access to pornography.

The defendant is charged with third-degree assault from a case that occurred in January at Pioneer Middle School. This case, along with the new case, were continued in court this morning. The defendant is now scheduled to appear in court on Nov. 6 to be sentenced on the Pioneer assault. A readiness hearing is also scheduled to take place Nov. 6 for the rape trial, which will determine if both parties are ready to go to trial.

The trial for the rape charges is set to begin Nov. 14, but the Clerk’s Office said this afternoon that date was set as a placeholder by the court, and it could be continued again. Both parties agreed this morning that they were not prepared for the original placeholder trial, which was set to begin Oct. 24.
